 MCA'S IMPEACH MORE GOVERNORS



Under Article 174 of Kenya’s 2010 Constitution,

devolution was intended to transfer control from the central to local

governments, to empower citizens and enhance their participation in the

management of their own affairs. But surprisingly governors have myriad of problems.

These problems include lack of enough health facilities and charging citizen

very highly to access these facilities. Governors are accused of living large,

as some have built mansion from unknown sources of funds. Counties lack job creation,

basic needs which include,food, nutrition, health services,

education, water, sanitation, shelter,a clean and beautiful environment. Governors are accused of corruption because of allegation of embezzling of funds and not

knowing how to manage the formal structures of government.The new system of

government, has also created a new sets

of elected representatives and bureaucracies, which is costly duplication of

goods and services (World Bank).Another issue is the devolution of

patronage-based politics and corruption.

  The Special Committee of the Senate,

formed to investigate allegations against Wajir Governor Mohamed Abdi Muhamud, recommended

his removal for abuse of office.Mr Abdi  is the third governor to be

removed from office through impeachment. Ferdinand Waititu (Kiambu) and

Mike Sonko (Nairobi) were both kicked out by the Senate last year.

The recommendation came after the governor was

impeached by members of county assembly (MCAs) on three counts, but only

one was substantiated.The MCAs noted that Wajir's health sector

has run into disarray and ended up in a deplorable state, which has

in turn comprised and undermined the realisation of the right to

the highest attainable health standards as enshrined in the Constitution.The

special committee, which was chaired by Nyamira senator Okong’o Omogeni, found

that the governor violated the rights of health of the people of Wajir.The

committee considered the evidence submitted by parties and found the

allegation of the violation of the rights of health of the people of

Wajir to have been substantiated and that the violation meets the

threshold of impeachment.Counties have created political polarisation and

inter-ethnic tensions that have characterised Kenyan politics in recent

years.90% of County workers are locals and in some Counties they use the local language to communicate with one another.All senior posts are given to the locals regardless of their education background.Another mistakes Counties do is the removal of residents from their business places and building sheds which they charge the same people exhorbitantly.The County askari's also do jobs which are not in their jurisdiction.Like arresting people and taking them to a magistrate court.The funds collected in the Counties are not put to audit which leads to corruption.County askari were voted in the category of the most corrupt people in Kenya. They have enriched themselves and only the constitution is the only one which can remove them from office or running the third term.Tenders are another thorny issue.Of all the 47 Counties majority of them give tenders to relatives and friends because most residents have never met people who get the tenders.Some governor's have survived impeachment because of these tenders.Garbage collection is another problem.Counties cannot manage the garbage collection and recycling.Counties employ people on nepotism.Many degree,master and PhD holders are jobless while counties lack expert in very many areas.Counties collect funds through taxes,houses,rates,adverts,licences,vehicles,daily market collection etc but employees have gone more than three months without salaries.This is sad indeed.Let MCA's impeach more governors.
