Let the court annexed medication process (camp) help reduce cases

The commercial division of the high court of appeal has resolved 25 cases with a total value  of sh 145 million within 10 months it has been in operational,as part of its intention to clear a backlog of disputes that drag on for years. A mediator assists the parties in working out a settlement that both can agree to. Such a settlement agreement is put in writing and signed by the parties, becoming a contract of sorts. 139 cases have been referred to the commercial division of the high court. A time has come when Kenyans should embrace mediation in order to solve disputes. Court cases breed hatred between those whose cases are judged in court. Even in the bible it says that, if you bring your gift to the altar,and there recall that your brother has anything against you,leave your gift there at the altar,go first and be reconciled with your brother,and then come and offer your gift.Settle with your opponent quickly while on the way to court. Otherwise your opponent will hand you over to the judge, and the judge will hand you over to the guard, and you will be thrown into prison. Cases which need a lot of arbitration include divorce,land,property, inheritances, burial,company,family etc. This reduces the number of active suits while helping litigants resolve disputes without stepping into a courtroom. Meditation has the potential to address complex cases,including firms and once agreement is reached it is not a subject of appeal. lt is a solution by you for you. The agreement  once adopted by both parties are enforceable as judgment/order of court. lf parties fail to reach a settlement, the matter reverts back to the normal court process. Mediation is often used in conjunction with  litigation, giving the parties the opportunity to reach a settlement and cancel the court proceedings. In some situations, mediators not only facilitate communication between the parties, but also make recommendations to the court in the event a resolution or settlement cannot be reached. One example of this is the mediation required in many jurisdiction between parents in child custody cases. Therefore it is a high time Kenyans who have cases in court embraced mediation for the sake of peace and unity.
